Om detta inte g\u00e5r att uppn\u00e5 och det tvingande lagpaketet klubbas igenom, kommer vi att ha mycket sv\u00e5ra kollektivavtalsf\u00f6rhandlingar framf\u00f6r oss n\u00e4sta \u00e5r. Det \u00e4r uppenbart att oron p\u00e5 arbetsmarknaden kommer att \u00f6ka och att arbetsfreden kommer att pr\u00f6vas h\u00e5rt i m\u00e5nga branscher, f\u00f6rutsp\u00e5r <strong>Maija Pihlajam\u00e4ki<\/strong>, ordf\u00f6rande f\u00f6r Offentliga och privata sektorns funktion\u00e4rsf\u00f6rbund Jyty.<\/p>\n<p>Hon framh\u00e5ller att tv\u00e5ngslagarna, om de g\u00e5r igenom, \u00e4r en sv\u00e5r kr\u00e4nkning av den traditionella v\u00e4sterl\u00e4ndska avtalsfriheten. Pihlajam\u00e4ki, som talade vid Jyty Torne\u00e5s 70-\u00e5rsjubileumsfest i l\u00f6rdags, p\u00e5minner oss om att regeringens f\u00f6rslag, om det f\u00f6rverkligas, bl.a. kommer att inneb\u00e4ra en f\u00f6rkortning av de l\u00e4ngsta semestrarna, mindre l\u00f6n under sjukfr\u00e5nvaro p\u00e5 grund av karenstiden vid sjukdom, l\u00e4gre semesterpenning samt att n\u00e5gra s\u00f6ckenhelger blir oavl\u00f6nade lediga dagar. Regeringen har sagt sig h\u00e5lla fast vid tidtabellerna och dess f\u00f6rslag p\u00e5 \u00e5tg\u00e4rder som eventuellt f\u00f6rb\u00e4ttrar kostnadskonkurrenskraften s\u00e4ndes ut p\u00e5 remiss i onsdags.<\/p>\n<p>Jytys ordf\u00f6rande Maija Pihlajam\u00e4ki betonar att risken f\u00f6religger att en eventuell tv\u00e5ngslagstiftning blir komplicerad och oklar med grundlagsenliga problem p\u00e5 flera st\u00e4llen enligt experterna. Pihlajam\u00e4ki f\u00f6rundrar sig \u00f6ver att arbetstagar- och arbetsgivarsidan inte har f\u00e5tt anm\u00e4la avvikande mening till lagpropositionen, trots att de har h\u00f6rts som experter i arbetsgrupper under beredningen av lagarna. En annan sak som v\u00e4cker f\u00f6rv\u00e5ning \u00e4r att effekterna av lagarna som ursprungligen endast skulle g\u00e4lla i tre \u00e5r nu verkar bli best\u00e5ende.<\/p>\n<p>&#8211; Organisationerna har fortfarande m\u00f6jlighet att f\u00f6rs\u00f6ka komma med ett ers\u00e4ttande avtal som f\u00f6rhindrar tvingande lagstiftning. Arbetsmarknadsparterna f\u00f6rv\u00e4ntas komma med ett f\u00f6rslag inom de n\u00e4rmaste veckorna. Vi som f\u00f6rbund sitter inte med vid f\u00f6rhandlingsbordet utan det g\u00f6r centralorganisationerna. Vi finns givetvis med i bakgrunden under f\u00f6rhandlingarna och p\u00e5verkar bildandet av ett avtal med olika metoder, p\u00e5pekar Pihlajam\u00e4ki.<\/p>\n<p>Jyty gjorde en unders\u00f6kning bland sina medlemmar i syfte att kartl\u00e4gga och st\u00f6da f\u00f6rhandlingsm\u00e5ls\u00e4ttningarna. N\u00e4stan 12 000 medlemmar deltog i unders\u00f6kningen.<\/p>\n<p>&#8211; I unders\u00f6kningen fick regeringens f\u00f6rslag till tv\u00e5ngslagstiftning g\u00e4llande konkurrenskraftsspr\u00e5nget p\u00e5 5 procent och f\u00f6rkortad semester ett f\u00f6rkrossande nej. Medlemmarna \u00e4r \u00e4ven ovanligt redo att ta till fackliga strids\u00e5tg\u00e4rder f\u00f6r att f\u00f6rsvara sina f\u00f6rm\u00e5ner, ber\u00e4ttar Pihlajam\u00e4ki.<\/p>\n<p>&#8211; Helt av annan \u00e5sikt eller delvis av annan \u00e5sikt var n\u00e4stan alla av Jytys medlemmar om p\u00e5st\u00e5endet \u2019Vi s\u00e4nker l\u00f6nerna med exempelvis 5 procent fr\u00e5n nuvarande niv\u00e5\u2019. Ett lika stort motst\u00e5nd v\u00e4cker det f\u00f6rslag som inneb\u00e4r att de l\u00e4ngsta semestrarna f\u00f6rkortas till 30 dagar.<\/p>\n<p>&#8211; S\u00e4rskilt or\u00e4ttvist \u00e4r det att f\u00f6rkortningen av semestern drabbar olika grupper av arbetstagare oj\u00e4mnt, huvudsakligen framf\u00f6r allt kvinnodominerade branscher inom kommunsektorn inom vilken personer som har varit i tj\u00e4nst i minst 15 \u00e5r har 38 dagar semester. Enbart en s\u00e4nkning av semesterpenningen skulle inneb\u00e4ra en avsev\u00e4rd l\u00f6nes\u00e4nkning p\u00e5 \u00e5rsniv\u00e5 f\u00f6r de personer som har r\u00e4tt till den l\u00e4ngsta semestern, po\u00e4ngterar Jytys ordf\u00f6rande.<\/p>\n<p>Vidare framh\u00e5ller hon att man en g\u00e5ng i tiden genom kollektivavtalsf\u00f6rhandlingar kommit \u00f6verens om att anv\u00e4nda en del av l\u00f6neh\u00f6jningsutrymmet till n\u00e5got b\u00e4ttre semesterf\u00f6rm\u00e5ner \u00e4n normalt i st\u00e4llet f\u00f6r till l\u00f6nef\u00f6rh\u00f6jningar.<\/p>\n<p>Semesterf\u00f6rm\u00e5nen har varit ett s\u00e4tt att locka folk att arbeta inom offentlig basservice och v\u00e4lf\u00e4rdstj\u00e4nster, d\u00e5 det inte har varit m\u00f6jligt att konkurrera med l\u00f6nen. Inf\u00f6randet av en karensdag vid sjukledighet mots\u00e4tter sig st\u00f6rsta delen av alla som deltog i Jytys unders\u00f6kning, detsamma g\u00e4ller s\u00e4nkningen av l\u00f6nen till 80 procent f\u00f6r sjukdag 2\u20138.
